Tally Wild Terms of Service
Effective date: October 20, 2026
These Terms of Service ("Terms") are an agreement between you and SKYZ the LIMIT LLC, an Ohio limited liability company doing business as Tally Wild ("we," "us," "our"), for use of Tally Wild, including the web app at app.tallywild.com and the Windows desktop app (the "Service"). By creating an account, starting a free trial, or using the Service, you agree to these Terms, the Subscription, Free Trial and Refund Policy, and the Acceptable Use and Flight Compliance Policy, which are part of these Terms. The Privacy Policy explains how we handle personal information. If you use the Service for a business, you agree for that business and confirm you can bind it.
1. What the Service does
Tally Wild is web and Windows desktop software that helps drone pilots organize their own flight files (pins, property lines, photos and videos), tag the animals and features they found, and produce wildlife analysis reports, maps, data files and invoices for landowners. Invoices are between you and your customer; Tally Wild does not collect or handle those payments. The Service is a tool. It does not fly drones, does not make the final call on what animals are in your photos (AI check only suggests answers, as section 3 explains), and does not guarantee any count, age, score, recommendation or result.
2. Who may use it
You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter a binding contract. You must give accurate sign-up and billing information and keep it current. One account is for one person; do not share your login. You are responsible for everything done under your account and must tell us right away at support@tallywild.com if you think someone else has used it.
3. Subscription, trial and payment
The Service is sold as a yearly subscription at $399 (or the discounted price shown at checkout), plus any taxes. New accounts may start one 14-day free trial with the limits listed in the Subscription, Free Trial and Refund Policy. You must enter a payment card to start the trial, and when the trial ends your card is charged automatically unless you cancel before it ends. Your subscription renews automatically each year until you cancel. Fees, renewal, cancellation and refunds are governed by the Subscription, Free Trial and Refund Policy.
Discount and partner links. We may give out links or codes that take a percentage off the yearly price, for the first year or for every year while the subscription stays active, and businesses we approve as partners may share links that carry a discount. The discount, and how long it lasts, is shown before you pay and on your account page. A discount is tied to the account that signed up with it, cannot be added after you subscribe, ends for good if your subscription ends, is not combined with another discount unless the checkout page shows both, and cannot be transferred. Partners are independent businesses, not our employees or agents, and cannot change these Terms or make promises for us. A partner earns a commission from us on what you pay when you sign up through the partner's link, and that commission never raises your price. We may stop offering a link at any time, but that does not change a discount you already have.
AI check (optional). AI check is an optional paid feature. When you run it, a reduced copy of one photo per pin, with its hidden data (GPS location, date and time, drone serial) removed, is sent through our server to our AI service provider (currently Anthropic), which suggests the animal type and, for bucks, the antler points, rack and age class. Our provider processes the photo copy under business terms that do not permit it to use the photos to train its models. AI suggestions are estimates and can be wrong. You are responsible for checking and correcting every suggestion before it goes in a report. Prices are shown before each check and in the Subscription, Free Trial and Refund Policy. We keep the AI's answer and your final answer to improve Tally Wild; we keep the photo copy only if training photo sharing is on.
4. Your license to use the Service
While your account is in good standing, we give you a personal, non-exclusive, non-transferable right to use the Service for your own work and your own customers. You may not:
copy, resell, rent, or offer the Service to others as a service of your own;
reverse engineer, decompile, scrape or try to get the Service's source code;
get around trial limits, usage limits, or security, including by opening extra accounts or trials;
upload viruses or anything meant to harm the Service or other users;
use the Service to build a competing product;
use automated or AI-driven browsers, bots or agents to sign in to or operate the Service, unless we allow it in writing (screen readers and other tools that help users with disabilities are allowed);
use, export or re-export the Service in violation of U.S. export control or sanctions laws, including from a country or region those laws bar or if you are a person those laws bar.
5. Your content and data
"Your Content" means the files you use with the Service (pin files, property lines, photos, videos, orthomosaics), the tags and notes you enter, and the reports the Service makes from them. Most photos and videos are read on your own device and are not uploaded; only map files, a report-size copy of the property area of any same-day orthomosaic you add (the full orthomosaic file is read on your device and never uploaded), your logo, and the photos you put in a report or an AI check are uploaded. You keep ownership of Your Content. You give us a limited license to store, copy, process and display Your Content only to run the Service for you, to share it with the people you choose, to keep backups, and to fix problems.
You promise that you have every right and permission needed to upload Your Content and to let us process it, including permission from each landowner whose property you flew and whose information appears in Your Content.
Training photo sharing (on unless you turn it off). Training photo sharing is turned on for new accounts. Accounts created before October 20, 2026 keep training photo sharing off unless the account holder turns it on. The first time you open Tally Wild, it tells you and lets you turn it off, and you can change it any time in Settings › Training photos, or turn it off for a single job in that job's last step. While it is off, we do not use your photos or videos to train software. While it is on, the program sends us the photos on animals you have marked done, with your labels (animal, species, points, typical or non-typical, age, camera type, drone model and month of the flight). Before sending, it removes the photo's hidden data (GPS location, exact date and time, drone serial). It never sends locations, property or client names, or file names.
For photos you share this way, you give us a non-exclusive, worldwide, royalty-free, perpetual license to store, copy and use the photos and labels to build, test and improve animal identification and other features of Tally Wild. We will not sell the photos or publish them as photos, and we will not use them to identify a property, landowner or pilot. Turning sharing off stops future sharing. To have photos you already shared deleted, email contact@skyzthelimitllc.com with the sharing ID shown in Settings › Training photos; features already built from them may remain.
You promise that you have the landowner's permission to share photos from their property this way, for example through your service agreement with them, and that you will turn sharing off for any job where the landowner does not agree.
6. Sharing reports
When you create a shareable link or send a report, anyone with that link can view it. You decide who gets it. Links are hard to guess and are not listed by search engines, but they are not password protected unless that feature is turned on. You can turn off a link at any time. To report material on the Service that you believe infringes your copyright, email contact@skyzthelimitllc.com with the information federal copyright law requires. If we remove your material after a complaint, we will tell you, and you may send us a counter-notice. In appropriate cases, we will close the accounts of users who repeatedly infringe the copyrights of others. We do not have to review what users share, but we may remove or disable access to any material that we reasonably believe breaks these Terms or the law.
Publishing to your own website (optional). If you enter your website's FTP details in Settings › Customer sharing, we store them, with the password kept in protected form, and use them only to upload the report files you choose to publish, to the folder you name on your website. Plain FTP can send your login details and files over the internet without encryption, so use a secure connection (SFTP or FTPS) where Tally Wild and your host both support one, and set up a separate FTP login that can reach only that folder. We protect the stored details as described in the Privacy Policy, but no system is perfectly secure, so change the password right away if you think it has been exposed. You are responsible for your website, your hosting account and who can reach the files there, and we are not responsible for your web host. You can remove the details at any time.
Find a Pilot map listing (optional). If you turn on a listing on the Find a Pilot map at tallywild.com, the map shows the details you choose: your name or business, your town (the pin sits at the town or zip code, never a street address), the services you offer, and, only if you choose, your phone number and website. Landowners can send you a message through the map, which we email to you. Use the details in a landowner's message only to reply to that landowner and for any work you agree on. A listing is free while your subscription is active; pilots without a subscription pay $100 per year and must give a valid FAA Part 107 certificate number, and their card is charged only once the listing is approved. A paid listing renews each year until canceled, under the Subscription, Free Trial and Refund Policy, and pilots who list without a subscription agree to these Terms and the Acceptable Use and Flight Compliance Policy. You are responsible for the accuracy of your listing and for any work you agree with a landowner; we are not a party to it and do not vouch for any pilot. We may refuse or remove any listing, and if we remove a paid listing for a reason other than a breach of these Terms or inaccurate listing details, we will refund the unused part of the listing year.
7. Storage, size limits and deleting data
Each plan has storage and upload limits shown in your account. We keep Your Content while your account is active. If your subscription ends, we keep Your Content for 60 days so you can renew or download it, then we may delete it permanently. Trial work is kept for 14 days after a trial ends without a subscription, then may be deleted. We are not a backup service; keep your own copies of your original flight files.
8. Your responsibilities as a pilot
You alone are responsible for how you fly and how you use reports, including following FAA rules, state and local drone laws, trespass laws, and state wildlife and hunting laws. The Acceptable Use and Flight Compliance Policy gives the details. We may suspend accounts that break it.
9. Our property
The Service, its software, design, report layouts, text, logos and the Tally Wild name belong to us or our licensors. Tally Wild™, The Rack Report™ and The Critter Count™ are trademarks of SKYZ the LIMIT LLC. These Terms do not give you any rights to them except the license in section 4. Your reports carry your own business name and logo, plus a small "Report made with Tally Wild™ · tallywild.com" line on the last page of the PDF; you may not remove that line or our trademark notices.
10. Feedback
If you send ideas or suggestions, we may use them without owing you anything. When something goes wrong in the app, or when you use Report a problem, the app sends us an error report so we can fix it; the Privacy Policy lists what it contains. Error reports never include your photos, pin files, property lines or landowner details.
11. Third-party services
The Service uses outside providers, for example for payments (Stripe), hosting and storage (Hostinger), email (Hostinger), AI check (Anthropic), encrypted backups, and satellite base maps. Their terms may also apply. Links to other websites, and files you export to other apps such as onX or Google Earth, are for your convenience. We do not control those sites or apps and are not responsible for their content or how they work. Satellite imagery may be out of date and is shown as provided by its source.
12. Changes to the Service and these Terms
We may add, change or remove features. We may update these Terms. If a change is material, we will email you or show a notice in the app at least 30 days before it takes effect. If you keep using the Service after that, you accept the new Terms. If you do not agree, you may cancel before the change takes effect. Price changes follow the notice rules in the Subscription, Free Trial and Refund Policy.
13. Suspension and termination
You may cancel at any time from your account settings. We may suspend or close your account if you break these Terms, do not pay, misuse the Service, or put other users or us at risk. If we close your account without cause, we will refund the unused part of your current paid year and any unused paid AI credits. Sections 5 (the license we need to finish deletion and backups, and the license for training photos you already shared), 9, 10, 14, 15, 16, 17 and 18, and your duty to pay any amount you owe, survive termination.
14. Disclaimers
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Animal counts, sex, age, antler points, ratios, densities, scores, maps, acreage, recommendations and AI check suggestions are estimates based on the data you provide and may be wrong. Reports are not a land survey, not a legal boundary determination, not a wildlife agency census, and not professional wildlife-management, legal or financial advice. We do not promise the Service will be uninterrupted or error-free. We also make no promise about how much business or income you will get from using the Service or a Find a Pilot listing.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR DAMAGE TO PROPERTY, DRONES OR ANIMALS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THE LAW DOES NOT ALLOW TO BE LIMITED. Some places do not allow some of these limits; in those places they apply as far as the law allows.
16. Indemnity
You agree to defend us against claims brought by others, and to pay the resulting losses and costs (including reasonable attorney fees), to the extent the claims come from Your Content, your flights, your use of reports, your dealings with landowners or customers, or your breaking these Terms or any law. This does not apply to the extent a claim is caused by our own breach of these Terms, negligence or misconduct. We will tell you promptly about any claim, let you control the defense with a lawyer reasonably acceptable to us, and not settle a claim in a way that requires you to pay or admit fault without your consent. You may not settle a claim in a way that requires us to pay, act or admit fault without our written consent, and we may take part in the defense with our own lawyer at our own cost.
17. Disputes and governing law
Ohio law governs these Terms, without regard to conflict-of-law rules. Before filing any claim, each side agrees to send the other a written description of the dispute (you by email to contact@skyzthelimitllc.com, and we by email to your account email) and to give the other side 30 days to try to resolve it. Any lawsuit must be brought in the state or federal courts serving Scioto County, Ohio, and both sides agree to those courts. Either side may instead bring an individual claim in a small claims court that has jurisdiction over it.
18. General
These Terms, together with the policies they name, are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver. You may not transfer these Terms without our written consent; we may transfer them with our business. Notices to us go to contact@skyzthelimitllc.com, and formal legal notices may also be sent by mail to our statutory agent at the address on file with the Ohio Secretary of State; notices to you go to your account email. You agree that we may give you notices electronically.
